The City of Frederick Picnic Committee contacted several vendors within the City of Frederick to submit quotations and samples of food for the City’s annual picnic. The samples were important to the committee because there had been concerns in the past about the quality of the food. Quotations and samples were submitted by two vendors, while one vendor submitted a quote, but refused to submit samples. As is standard City policy, “Any contractor or vendor that does not comply totally and completely with the bid information requested is deemed nonresponsive”. The Committee selected the second lowest bidder based on both the quality and price.
