CONSENT AGENDA:

All matters included under this item are considered to be routine by the Mayor and Board of Aldermen. They will be enacted by one motion in the form listed below, without separate discussion of each item, unless any person present -- city official or citizen -- requests and item or items to be removed from the Consent Agenda. Any item removed from the Consent Agenda will be considered separately at the end of the Consent Agenda. If you would like any of the items below considered separately, please say so when the Mayor announces that the Board will consider the Consent Agenda.

A. Agreements Between City and Developers

1. Approval of release of Frontier Bond No. 143557 in the amount of $78,786 posted by Crum Home Farm, L.P., as guarantee of completion of Grading/SEC measures to North Crossing, SWM Pond No. 2, further described in PWA dated 07/14/99.

2. Approval of release of Cash funds in the amount of $50,772 posted by Ballenger, DW, LLC, as guarantee of completion of improvements to Ballenger Creek Center, Lots 3 & 4 (Debtworks site) per PWA dated 11/26/01.

3. Approval of release of Continental Bond No. 190484231 in the amount of $83,835, posted by M.O.R.P. Frederick Associates as guarantee of completion of off-site waterline improvements to Ballenger Creek Center per PWA dated 11/30/98, and acceptance of same along Ballenger Creek Pike, Station 20+00 to 66+62.

4. Approval of release of Cash Funds in the amount of $55,248.90, posted by M.O.R.P. Frederick Associates as guarantee of completion of public improvements to Ballenger Creek Center, Cawley Drive, Station 0+00 to 9+00, further described in PWA dated 12/01/99, and acceptance of same into City’s system.

5. Approval of release of Continental Casualty Bond No. 190484276 in sum of $160,125, posted by M.O.R.P. Frederick Associates as guarantee of completion of public improvements to Ballenger Creek Center, Ballenger Center Drive, Station 11+05 to 26+16.34, further described in PWA dated 10/26/98, and acceptance of same into City’s system.

6. Approval of release of American Motorist Bond No. 3SM98294900 in sum of $18,420, posted by WBF, LLC, as guarantee of completion of afforestation improvements to Willowbrook, Stands 3, 4 & 5 further described in FCA dated 08/08/00.

E. Committee Recommendations

1. Approval of a recommendation made by the Utility Committee at their meeting on May 14, 2003, to grant a deferral to CareNet Pregnancy Center of Frederick, 707-709 North Market Street, of the City requirement of one water/sewer tap per lot until such time as there is further development of the site.
