ORDINANCE NO. G-07-27

 

AN ORDINANCE concerning: the building code appeals board

 

FOR THE PURPOSE of expanding the duties of the building code appeals board

 

BY AMENDING Section 2-46 of the Frederick City Code, entitled “Duties”;

 

Section 1.  BE IT ENACTED AND ORDAINED BY THE MAYOR AND BOARD OF ALDERMEN OF THE CITY OF FREDERICK that in Article V of Chapter 2 of the Code of the City of Frederick, 1966, as amended, Section 2-46, entitled "Duties" is amended as follows:

 

Sec. 2-46. Duties.

 

(a) The building code appeals board shall:

 

(1) Sit as a board of arbitration with respect to any disputes that arise involving an interpretation of provisions of the building code or the regulations promulgated thereunder; [and]

 

(2) Hear appeals of [the issuance, transfer, renewal, refusal, suspension, revocation, or cancellation of any permit or license issued pursuant to the building code] actions of the Code Official as set forth in section 5-25 of this Code; and

 

(3) Hear appeals of notices of violation as provided in any other provision of this Code.

 

Section 2. BE IT FURTHER ENACTED AND ORDAINED BY THE MAYOR AND BOARD OF ALDERMEN OF THE CITY OF FREDERICK that in the event any provision, section, sentence, clause or part of this Ordinance shall be held to be invalid, such invalidity shall not affect or impair any remaining provision, section, sentence clause or part of this Ordinance, it being the intent of the city that such remainder shall be and shall remain in full force and effect.

 

Section 3.  BE IT FURTHER ENACTED AND ORDAINED BY THE MAYOR AND BOARD OF ALDERMEN OF THE CITY OF FREDERICK that this Ordinance shall take effect as of the date of its passage, and all other ordinances or parts of ordinances inconsistent with the provisions of this Ordinance will as of that date be repealed to the extent of such inconsistency.
