ORDINANCE NO. G-07-23

 

AN ORDINANCE concerning vehicles in city parks and grounds

 

FOR THE PURPOSE of amending the Code of the City of Frederick

 

BY AMENDING Section 15-34 entitled “Vehicles on city lands, etc."

 

NOW, THEREFORE, BE IT ENACTED AND ORDAINED BY THE MAYOR AND BOARD OF ALDERMEN OF THE CITY OF FREDERICK:

 

Section 1.  Section 15-34 of the Frederick City Code (1966, as amended) is amended as follows:

 

Sec. 15-34. Vehicles on [city] City lands[, etc].


(a) [No person shall] An individual may not ride [any bicycle or] an animal[,] or [shall drive any] operate a motor vehicle or animal-drawn vehicle[,] in or upon the public parks [and] or grounds of [the city] The City of Frederick except in areas designated by signs or unless written permission has been granted by the [city] City. Violation of this section is declared to be a municipal infraction punishable by a fine of $25. [The penalty for violation shall be the sum of twenty-five dollars ($25.00).]

 

(b) Subsection (a) does not apply to [Employees] employees of [the city are hereby exempt from this section and are permitted to ride on and over the public parks and grounds of the city while] The City of Frederick engaged in the performance of their duties.

 

Section 2.  In the event any provision, section, sentence, clause or part of this ordinance shall be held to be invalid, such invalidity shall not affect or impair any remaining provision, section, sentence, clause or part of this ordinance, it being the intent of the city that such remainder shall be and shall remain in full force and effect.

 

Section 3.  This ordinance shall take effect as of the date of its passage and all other ordinances or parts of ordinances inconsistent with the provisions of this ordinance will as of that date be repealed to the extent of such inconsistency.
