NAC 7 Monthly Meeting                                           August 1, 2006 Meeting

Officer Greg Stocksdale:

 

There were 2 bank robberies today.  The robber that hit Farmers and Mechanics got into a taxi to Baltimore and was captured.  The Spectrum FCU (Route 40) robber is still at large.

There have been the normal traffic complaints.  The police dept is short staffed; however, they have 9 new graduates.

There are still car break-ins.

The robber that hit the Monocacy Shopping Center was caught.

The police dept is undergoing police accreditation.  This one is an administrative examination. You can email Sgt Trapp as he is working day shift this week.

Staley Park closes at 10 p.m., but the police use 11 p.m.  There have been persons found sleeping in Baker Park.

They have been monitoring gang activity and nothing is showing an increase.

Some citizens told the officer of speeding problems.

 

Gerald Palm spoke about Yard Waste:

 

Biodegradable twine must be used when bundling.

Bulk pickup is in the Fall and Spring. You can call for 1 pickup in between for a $40 fee.

There were complaints that city residents should be entitled to County Pick up. Talk to your County Commissioners.

If it looks like grass, then it is grass and grass is unacceptable.

 

Alderman Alan Imhoff:

 

He can answer questions about the planning process or any preliminary plan approvals, but if final site plan is not approved, he cannot answer questions or talk about it.

The Land Mgmt Code is confusing and he has a 14 year background with the LMC.

There will be new GIS (global information system) on the internet that allows you to see applications, allows you to get crime statistics, etc.

 

 

 

 

 

Alderman Donna Ramsburg:

 

She would like the city to hire a land use attorney and explained the advantages. Our city attorneys are not land use experts.  Alan Imhoff agreed saying they really need the expertise to protect the planning commission. E-mail your alderman.

 

This Thursday night, the mayor and board of alderman will be discussing the Land Mgmt Codes.

Alan & Donna have requested that developers meet with adjoining neighbors.

To be informed of what permits have been applied for etc, read the public notices in the newspaper and watch channel 99.

Under the new code, all building applications will come to the NAC.  Our NAC is one of the best on getting information out!

 

The final site plan hearing for Canterbury Station has been reschedule from August 14th to August 21st.  Citizens were upset because the date had been changed and a couple of citizens had changed vacation plans to be here on the 14th.  Write the planning dept., Alderman, planning commissioners, and the mayor.  The big question is notification of date change.

 

There are site plan criteria which are the only legal reason the planning commission can use to make decisions.   The planning commission’s judgment and decisions can be taken to court.  The planning commission is assumed to be correct if proper reasoning is applied.

 

 

(2)116   Site Plan Review Criteria

In the review of a site plan, the Planning Commission shall review the site plan for compliance with the provisions of this ordinance and principals of good planning and design, so as to further the intent and purpose of this ordinance and to assure development which is compatible with surrounding properties and public facilities.

The applicant must demonstrate that the site plan meets the following criteria and will not be detrimental to the public health, safety or general welfare.

a.          The development shall provide adequately for parking and for safe access to and from public streets and highways, which provides for safe and functional circulation of vehicular and pedestrian traffic.

b.         The development shall provide for open space and parkland, when required, and protect sensitive natural areas from development which minimizes natural hazards.

 

c.         The development shall be adequately served by public facilities

and services, such as sewer, water, streetlights, sidewalks, storm water management and/or storm drains; and police, fire and refuse collection.

(3)1 '    The Commission may require any reasonable changes to the proposed site plan which is considers necessary, to comply with the requirements of this ordinance and assure compliance with criteria of Section 6.07(2).

(4)       Site plans for which storm water management and or sediment and erosion control measures are required will be reviewed by the City Engineer and Soil Conservation Service for compliance with City and State requirements. The storm water management criteria adopted by the City requires the two (2) and ten (10) year post development peak discharge rates shall be controlled and released at the respective two (2) and ten (10) year predevelopment rates. The difference between the predevelopment and post development runoffs for the two (2) and ten (10) year storms shall be retained in an approved storm water management facility. Properties located in the Carroll Creek watershed, including its tributaries, must also control the one hundred (100) year storm event.

The building heights of Canterbury Station have not been approved. The lighting plan is now required. The developer has 1 year after site plan approval to get started. Once the engineering department signs off, grading is permitted.  Zoning is done during the comprehensive planning. Zoning can be changed if there has been a change in the neighborhood or there was a mistake in zoning.  The next comprehensive plan is to be done in 2009.

 

The Gas House Pike realignment has gone through.  They are in preliminary discussions on Nicodemus property.  Regarding ADDU’s  - room over the garage, the code allows for detached and attached.  How do you figure water and potential for additional students?  There are also concerns with the FAA and the airpark.

 

Earl Smith gave us a report on the all NAC meeting that took place 7/31/06. There was an explanation on the APFO and how difficult it is to get things done because it involves county, state, and federal.  Alan Imhoff gave an example of the importance of talking to elected officials.
