1)  Plat Note for Non-Residential Projects with Water and Sewer Allocation Contract:

 

The City of Frederick has allocated a total of ________ gallons per day of potable water and wastewater treatment capacity to serve all or a portion of the lots shown on this plat in accordance with a Water and Sewer Allocation Contract (WSAC___ - _____) between the owner and the City dated ________________.  Recordation of this plat does not constitute a guarantee or allocation of potable water capacity or wastewater treatment capacity to serve the development of all the lots shown on the plat, nor does recordation of a lot or lots without a Water and Sewer Allocation Contract entitle the owner to a preferred allocation status as provided in of the Water and Sewer Allocation Ordinance.  Water allocation for the lots under Water and Sewer Allocation Contract (WSAC___ - _____) or any subsequent water allocations granted by the City for the remaining lots on the plat, if any, shall be in accordance with and subject to the provisions of the Frederick City Code, Appendix A (“The Land Management Code”), § 742, “Water and Sewer Allocation” and the regulations adopted pursuant thereto.  If a building permit is not issued, a water and sewer tap not purchased, and foundation construction not commenced on a lot within the time period provided in the Water and Sewer Allocation Contract (as it may be modified or extended), the potable water supply capacity allocation and wastewater treatment capacity for any lot not in compliance with the requirements listed herein is no longer reserved, and the ability to permit and develop lots will be dependent on potable water supply and wastewater treatment capacity available at the time of building permit application.  Federal or State action, including operational moratoria, may temporarily suspend, delay or otherwise affect an allocation that is granted.

 

2)  Plat Note for Residential Projects with Water and Sewer Allocation Contract:

3)  Plat Note for Projects with a previously recorded plat but has existing vacant, undeveloped lots but does not requiring a Water and Sewer Allocation Contract, where a Consolidation Plat, Addition Plan, or Re-subdivision such that no new lots are created.

 

The City of Frederick has previously recorded a plat of this property, at which time a six (6) month reservation of wastewater treatment capacity was granted.  That reservation of wastewater treatment capacity has expired, and therefore recordation of this plat does not constitute a guarantee or allocation of potable water capacity or wastewater treatment capacity to serve the development of all the lots shown on the plat.  The ability to permit and develop the lots shown on the plat will be dependent on the potable water supply and wastewater treatment capacity available when a building permit is requested.  Building permits may not be issued until it has been determined that existing facilities are adequate and available to meet needs of the proposed development taking into account all existing and approved developments in the service area and that the water supply needs described in the building permits application will not overload any present facility for conveying, pumping, storing, or treating water.   If a Water and Sewer Allocation Contract has not been previously granted to all or a portion of the lots shown on the plat, then prior to issuance of a building permit for a development that requires potable water a Water and Sewer Allocation Contract will need to be obtained.  Federal or State action, including operational moratoria, may temporarily suspend, delay or otherwise affect an allocation that is granted.

 

4) Plat Note for Projects with either a lot of record or old plat with existing structures on the lot(s) and is not requiring a Water and Sewer Allocation Contract, where there is a Consolidation Plat, Addition Plan, or Re-subdivision such that no new lots are created.

This proposed (Final Site Plan / Preliminary Subdivision Plan) will be dependent on the potable water supply and wastewater treatment capacity available when a building permit is requested.  Building permits may not be issued until it has been determined that existing facilities are adequate and available to meet needs of the proposed development taking into account all existing and approved developments in the service area and that the water supply needs described in the building permits application will not overload any present facility for conveying, pumping, storing, or treating water.   If a Water and Sewer Allocation Contract has not been previously granted to all or a portion of the lots shown on the plat, then prior to issuance of a building permit for a development that requires potable water a Water and Sewer Allocation Contract will need to be obtained.  Federal or State action, including operational moratoria, may temporarily suspend, delay or otherwise affect an allocation that is granted.
