TAXICAB COMMISSION MEETING

3:30 p.m.

Monday, October 9, 2006, room 212, City Hall

 

Present:  Alderman Donna Kuzemchak Ramsburg, Alderman Marcia Hall, Lt. Tom Chase, Jerry Wood, William Bowie, Daniel Mahone, Rachel Depo, Eileen Farrar

 

Item 1:  Approval of the minutes from the meeting of October 5th, 2006

Minutes were tabled due to all parties of the Commission not present

Item 2:  Review of decision by the Taxicab Commission of appeal by Mr. Dan Mahone on behalf of Mr. William Bowie of Bowie Transportation

Alderman Ramsburg stated that this item was dismissed. Alderman Ramsburg stated that after discussions with the City Attorney, the commission was told that they did not have the ability legally to accept an appeal due to the absence of a right to appeal in the Ordinance.

Item 3:  Discussion and review of portions of the Taxicab Ordinance

Alderman Ramsburg stated that this item should be discussed at a future meeting after the city attorney has an opportunity to further review the Ordinance.  Ms. Rachel Depo agreed.  Alderman Hall stated that recent discussions have indicated that there is a need for a review of ambiguities of the Ordinance. Alderman Ramsburg stated that there will be a meeting with the City Attorney for a review of the Ordinance before the next meeting and that this will be discussed at the next meeting in November. 

 

Public Comment:

Mr. Dan Mahone stated that he felt Section 23-3 of the Ordinance explains jurisdiction over the appeal process.  Mr. Mahone stated that there have been errors in the Ordinance pointed out to the Commission and further explained how existing Section 23-9 pertains to their appeal. Mr. Mahone found fault in the renewal process with regard to passing of inspections.  Mr. Mahone felt that Mr. Bowie has complied with Section 23-9.  Mr. Mahone also pointed out that he felt that the fines are extreme and far exceed the actual cost of the permit itself.

 

Mr. William Bowie was sorry to hear of this decision and felt that the excess fines and rules put forth in the Ordinance by the previous Taxicab Commission may have been produced to put undue hardship on his company and to possibly force him out of business. 

 

The next Taxicab Commission will be held on Thursday, November 2nd at 9:00 am in 212 at City Hall.
