Chapter 25 WATER*
Sec. 25-32. Frederick City Water Sheds.
There is designated an area known as the Frederick City Water Sheds,
being Fishing Creek Water Shed bounded on the west generally by Ridge Road or
Gambrill Park Road, on the northeast by Old Frederick Road, also known as Right
Hand Ford Road, and on the south generally by Hamburg Road (Yellow Springs Road
Extended), including ground to the south located in the Tuscarora Water Shed;
and being Linganore Water Shed bounded on the west by Linganore Road, on the
south and east by Linganore Creek and on the northeast generally approximately
three thousand six hundred (3,600) feet above the existing filtration plant,
encompassing approximately eight thousand (8,000) acres of ground.
The
following rules and regulations shall apply to the Frederick City Water
Sheds:
(a) Camping. There shall be no camping in the Frederick City
Water Sheds, except as may be hereinafter designated by the mayor and board of
aldermen of the city.
(b) Fires. There shall be no fires except under
a permit obtained from the city, and no persons shall kindle, build, maintain or
use fire in the Frederick City Water Sheds in areas other than those provided or
designated for that purpose. Each fire must be contained under the care and
direction of a competent person over the age of eighteen (18) years. Before it
is left, each fire must be thoroughly extinguished. Fire permits may be revoked
by any park officer or police officer of the city at any time. The building or
starting of any fire in public use areas in the Frederick City Water Sheds may
be prohibited by any park officer or city police officer when the fire danger
warrants such action.
(c) Lighted cigars, cigarettes, etc. No person
shall throw away or discard in the Frederick City Water Sheds any lighted match,
cigarette, cigar or other burning object constituting a fire
hazard.
(d) Refuse and rubbish. No person may deposit in any part of
the Frederick City Water Sheds any garbage, sewage,, waste, foodstuffs, paper or
other litter or obnoxious material, except in containers provided for the
purpose in such designated areas.
(e) Damage to public property. No
person shall injure, deface or vandalize any part of the Frederick City Water
Sheds or any building, sign, equipment or any public property
therein.
(f) Trees, flowers and plants. No person, except duly
authorized personnel or persons acting pursuant to a valid permit with the city
shall remove or destroy any plant life, rock or mineral in any part of the
Frederick City Water Sheds.
(g) Gambling and intoxicants. Gambling,
games of chance and fortunetelling are prohibited in the Frederick City Water
Sheds and no minors shall transport or possess any intoxicating beverages in the
Frederick City Water Sheds.
(h) Traffic and parking. There shall be
no vehicular traffic of any kind off the road systems of the Frederick City
Water Sheds except in designated areas or trails. And the following shall be
prohibited in the Frederick City Water Sheds: For anyone to drive or park any
vehicle upon the safety zones, walks, bridle path, logging trails or any other
place not designated or to cause or permit a motor vehicle to obstruct traffic
by unnecessary stopping. 25-32
All vehicular traffic over the roads in the
Frederick City Water Sheds shall be subject to the rules and regulations of
Article 66½ of the Annotated Code of Maryland.
(i) Washing and
repair to vehicles. No persons shall wash or repair, except in emergency
situations, any vehicle of any kind within the Frederick City Water
Sheds.
(j) Pets. No pets shall be allowed in the Frederick City Water
Sheds except under the control of a competent individual. Horseback riding shall
be permitted only in designated areas of the Frederick City Water
Sheds.
(k) Advertising. No signs, notices or literature may be
erected, posted or handed out in any areas of the Frederick City Water Sheds,
and public address systems shall be operated only in an emergency situation by
authorized personnel.
(l) Meetings, exhibitions and demonstrations.
No person may, within the Frederick City Water Sheds, erect structures, stands
or platforms or hold any meetings, exhibitions, ceremonies or
demonstrations.
(m) Commercial enterprises. No persons shall, in the
area designated as the Frederick City Water Sheds, hire, lease or hire out for a
monetary consideration any object of merchandise or any vehicle designated for
use for transportation of persons or property.
(n) Fishing and
hunting. Fishing and hunting shall be permitted in the Frederick City Water
Sheds, except in posted areas, provided it is done in conformity with state
laws.
(o) Weapons. Firearms may be carried in the Frederick City
Water Sheds by licensed hunters during regular hunting seasons, provided it is
done in conformity with the state laws.
(p) Designated areas. The
city may designate certain areas of the Frederick City Water Sheds for camping,
picnics, target shooting, fishing, hunting, horseback riding, fires, snowmobiles
and other vehicular traffic and such areas shall be readily
defined.
(q) Closing against entry. No person or vehicle other than
designated personnel or police officers or employees of the city on official
business may enter, go upon or remain upon the lands of the Frederick City Water
Sheds after the posted hours for closing to public use or during such periods
when such lands are closed to public entry by the mayor and board of
aldermen.
(r) Swimming and boating. Swimming and boating shall not be
allowed on any lake, stream, river or other waters located within the Frederick
City Water Sheds.
Any of the foregoing violations of the rules and
regulations shall constitute a municipal infraction. The penalty for violation
shall be the sum of twenty-five dollars ($25.00). (Ord. No. G-74-17, § 1;
