Sec. 23-50. Sustained complaints, sanctions.


(a) In addition to any penalty for any violation for any section in this chapter, the commission shall have the authority to issue sanctions in conformity with the provisions of this section against permit holders and operators.
(b) The commission shall have full authority and discretion in issuing sanctions for sustained complaints.
(c) The following sanctions may be issued for sustained complaints:
(1) Fewer than two (2) sustained complaints within one calendar year may result in a warning by the commission and/or a fine not to exceed one thousand dollars ($1,000.00).
(2) Greater than three (3), but fewer than five (5) sustained complaints within one calendar year, may:
(A) Result in a fine not to exceed one thousand dollars ($1,000.00) per complaint;
(B) The suspension of the operator’s license; and/or
(C) The suspension of the permit holder’s permit.
(3) Any number of sustained complaints greater than five (5) within one calendar year may result in:
(A) The suspension or revocation of one or more of the permit holder’s permits, if more than one is held;
(B) A fine not to exceed of one thousand dollars ($1,000.00) per complaint; and/or
(C) The suspension or revocation of an operator’s taxicab license. (Ord. No. G-04-10, 6-3-04)
