Sec. 23-9. Same--Nonoperating permits.


(a) Once a new, renewed, or transferred permit has been issued as required under the provisions of this chapter, the holder of such permit, shall, within thirty (30) days of such issuance, specify a vehicle to be operated in compliance with the permit and provide to the taxicab administrative agency written proof of the following for each vehicle to be operated with such permit:
(1) The make, year, model of the taxicab, and its vehicle identification number;
(2) A certificate from the insurance company, signed by an authorized agent, that the policy has been issued, specifying the terms of the policy and the effective dates of the policy;
(3) A copy of the Inspection Certificate Maryland State Police Form MSP 23-63 (revised March, 1998) from a Maryland State Inspection Station; and
(4) A copy of the vehicle’s registration from the Maryland Motor Vehicle Administration.
(b) Failure to comply with the requirement of subsection (a) of this section shall result in a fine of fifty dollars ($50.00) per day for each day exceeding the thirty (30) day limit for the first fourteen (14) days, and then one hundred dollars ($100.00) per day thereafter.
(c) Failure to comply with the provisions of subsection (a) of this section after a period of sixty (60) days from the issuance of a new, renewed, or transferred permit shall result in the automatic forfeiture of such permit to the commission.
(d) A taxicab permit holder whose permit has been forfeited under subsection (c) who alleges that an emergency situation has prevented the permit holder from meeting the requirements of subsection (a) may file an appeal in writing within ten (10) business days of the notice of forfeiture of the permit card to the commission.
(1) Emergency situation is defined as:
(A) A medical event in which a person is physically unable to provide the requisite paperwork to the commission; or
(B) An unforeseeable event which renders registration and payment of fees impossible.
(2) Upon written appeal to the taxicab administrative agency, the commission shall convene a hearing to review the merits of such appeal within forty-five (45) business days of the noting of such appeal.
(3) A timely appeal shall stay the forfeiture of the permit. (Ord. No. G-04-10, 6-3-04)
