Chapter 23 TAXICABS*
ARTICLE III. TAXICAB PERMITS
Sec. 23-7. Same--Issuance of new transferable permits.
(a) Upon the effective date of this chapter, the commission shall
allow existing taxicab permit holders to purchase new transferable taxicab
permits as described in this article.
(1) Existing taxicab permit holders
shall have the option to purchase one new transferable permit for each existing
permit held.
(2) The cost of a new transferable permit to existing taxicab
permit holders shall be five hundred dollars ($500.00).
(3) Existing taxicab
permit holders shall have twenty-one (21) calendar days from the date which this
chapter is effective to render full payment. Payment shall be made to the
taxicab administrative agency.
(4) Failure to render payment within
twenty-one (21) calendar days as required by subsection (a)(3) of this section
shall result in the forfeiture of the permit on the twenty-second (22) calendar
day.
(b) Upon the effective date of this chapter, the taxicab administrative
agency shall permit any individual whose name appears on the waiting list
(Appendix A) to purchase any remaining permits.
(1) The names appearing on
the waiting list (Appendix A) shall be advertised, providing those individuals
with an opportunity to inform the taxicab administrative agency of their intent
to obtain such permits.
(2) The cost of a taxicab permit for individuals
described in this subsection, for individuals named on the waiting list
(Appendix A), shall be one thousand dollars ($1,000.00).
(3) Individuals
named on the waiting list (Appendix A) described in this subsection shall have
twenty-eight (28) calendar days from the date which this chapter is effective to
render full payment. Payment shall be made to the taxicab administrative
agency.
(4) Failure to render payment within twenty-eight (28) calendar days
as required by subsection (b)(3) of this section shall result in the termination
of such individuals’ right to issuance of any permit.
(c) On calendar
day twenty-nine (29) after the effective date of this chapter, the commission
shall issue any permit not heretofore issued pursuant to subsections (a) and (b)
of this section not exceeding fifty-five (55).
(1) Any permit issued
pursuant to subsection (c) of this section shall be issued by lottery in
accordance with procedures set forth by the taxicab administrative agency and
approved by the commission.
(2) The imposition and collection of fees for
the issuance of any taxicab permit issued pursuant to subsection (c) of this
section shall be in accordance with section 23-10 of this chapter.
(d) After
all permits have been issued following the effective date of this chapter, the
commission may issue any permits that from time to time come back into the
possession of the commission.
(1) Any permit issued pursuant to subsection
(d) of this section shall be issued by lottery in accordance with procedures set
forth by the taxicab administrative agency and approved by the
commission.
(2) The commission’s intent to issue permits shall be
advertised, providing individuals with an opportunity to provide the commission
with notification of intent to obtain such permits and an opportunity to be
entered into the lottery described in subsection (d)(1) of this
section.
(e) Subsequent to the enactment of this chapter, the city shall no
longer keep a waiting list of names of individuals or entities seeking taxicab
permits.
(f) Individuals who are not awarded taxicab permits in any lottery
conducted by the commission shall not hold a superior position for future
taxicab permits in any subsequent lottery. (Ord. No. G-04-10, 6-3-04)
