Sec. 22-52.5. Restrictions on animals and equipment.


(a) It shall be the responsibility of the owner of any commercially operated horsedrawn vehicle business to use the appropriate horses trained for intercity service as referenced in the Iowa State College of Agriculture’s 1926 study on draft horses, in said operation.
(b) No stallions may be used to pull any commercially operated conveyance within the city.
(c) No mares with unweaned foals shall be used in said business.
(d) Only horses four (4) years old and older as stated on their health papers shall be permitted to pull any commercially operated vehicles. Such activity may only commence after all health and Coggins papers, accompanied by a photograph of the subject animal, has been submitted to the authority.
(e) All animals engaged in the pulling of commercially operated vehicles shall be shod with either metal shoes coated with driltex or burium or, in the alternative, rubber shoes. All four (4) shoes must be tight and in place at all times.
(f) Waste catchers shall be in place and functioning properly at all times. It shall be the responsibility of the vehicle operator to clean up any spillage. Waste catchers shall be emptied immediately upon use. If use of a waste catcher occurs while the horse is pulling a vehicle, the waste catcher shall be emptied immediately upon return to the boarding area. Environmentally safe fly spray shall be used after each collection of waste during warm or hot weather. The waste collected shall be stored in plastic bags inside a rigid container and stored out of the public traffic areas. After urination of the horse, water shall be used to immediately flush the area involved.
(g) Tie ropes used around the neck or attaching to the halter shall be carried on all commercially operated horsedrawn vehicles whenever said vehicle is placed into service. No horse shall be tied using the bridle, bit or reins.
(h) No animal engaged in the pulling of horsedrawn vehicles shall work more than five (5) hours before receiving a one hour break. Thereafter, said animal may only work an additional three (3) hours for a total time of eight (8) hours in harness.
(i) It is the responsibility of the owner of each horsedrawn vehicle business to have at the passenger boarding site a water bucket for each team or series of horses, and to offer said horses water after completion of each tour or outing.
(j) No commercially operated horsedrawn vehicle business may operate when the temperature reaches fifteen (15) degrees nor when temperatures reach ninety degrees (90) degrees or higher as determined by the thermometer at the Frederick City Airport. Exceptions shall be made when written proof of a reservation having been made for such service at least one week previously is submitted to the authority. In such cases, the operator is permitted to perform said service and then shall remove the animals and vehicle from the street.
(k) Horsedrawn vehicles shall operate between the hours of 8:00 a.m. and 1:00 a.m., and at all times shall operated at the discretion of the authority, so as not to disturb the public.
(l) Violation of this section is declared to be a municipal infraction punishable by a fine not to exceed four hundred dollars ($400.00) and/or suspension or revocation of carriage license. (Ord. No. G-94-73, § 1, 10-6-94)
