Sec. 22-52.4. Designated areas of operation.


(a) The authority shall designate boarding areas within the city that will be used by all commercially operated horsedrawn vehicles to load and unload passengers.
(b) Each horsedrawn vehicle business shall be assigned a boarding area and shall be provided one space for the parking of carriages and the loading of passengers. Extra spaces will be provided at the discretion of the authority, dependent upon availability. However, no operator of a horsedrawn vehicle shall board passengers within one thousand (1,000) feet of the public boarding point of a preexisting permitted operator.
(c) The authority shall designate specific routes where travel of commercially operated horsedrawn vehicles are prohibited. Designation of these routes are at the discretion of the authority, but no commercially operated horsedrawn vehicle is permitted to function inside an area so designated. Exceptions to this rule may be granted in writing at the discretion of the authority for private use purposes (i.e., weddings, parades).
(d) Solicitation for horsedrawn vehicle rides within the designated areas of operation is limited to salutations and the presentation of cards offering the service with enclosed rates. No signs or other forms of solicitation shall be permitted.
(e) Violation of this section is declared to be a municipal infraction punishable by a fine not to exceed four hundred dollars ($400.00). (Ord. No. G-94-72, § 1, 10-6-94)
