Sec. 22-52.3. Inspections required.


(a) The authority or its designated representatives shall physically inspect all carriages and equipment used in the operation of horsedrawn vehicles prior to the issuance of a permit for such activity.
(b) Any accident involving a horsedrawn vehicle must be reported to the Frederick City police department and the authority as soon as possible following the occurrence. The carriage and all equipment involved in the occurrence shall be inspected by the authority or its designated representatives in substantially the same condition as it appeared immediately following the occurrence. Said inspection to take place as soon after notification of the authority by the company owner as possible. Any carriage involved in any accident shall be required to be submitted to the authority for inspection prior to being placed back into service.
(c) The authority or its designated representatives shall be entitled to inspect any carriage operation, carriage, equipment, animals used in such activity, and stables, if located within the city, at the discretion of the authority to ensure the public safety and the proper care and maintenance of the animals used in such operations.
(d) Violation of this section is declared to be a municipal infraction punishable by a fine not to exceed four hundred dollars ($400.00) and/or the denial or suspension of the horsedrawn vehicle permit. (Ord. No. G-94-71, § 1, 10-6-94)
