Sec. 22-52.1. License required--Driver.


(a) The driver of any commercially operated horse drawn vehicle shall, prior to the commencement of such activity, apply to the authority for a city license to operate such a vehicle and be in receipt of said license. The applicant for a horse drawn vehicle license shall meet all of the following minimum requirements before a license may be issued:
(1) The applicant shall be sixteen (16) years old or older and shall possess three years of general experience driving a horse drawn vehicle.
(2) The operator of the business shall file with the authority a certification that the operator has examined the skills of the applicant and determined the applicant to be competent to drive a single, pair, three abreast, four horses in hand or all the above, and that the applicant shall only drive the configuration(s) stated.
(3) The applicant must file with the authority an application for a horse drawn vehicle license on a form supplied by the authority together with the above documentation and legal proof of age and driving experience. A fee of twenty-five dollars ($25.00) shall be paid upon submission of the application.
(b) The license to drive a horse drawn vehicle shall be issued with a recent photograph of the driver affixed to it and laminated together. The license shall be displayed in a conspicuous place on the carriage in a manner so as to permit passengers easy access to such information.
(c) Upon approval by the authority of a license to operate a horse drawn vehicle, the police department shall issue said license to the applicant. The license shall be valid for three (3) years.
(d) The employment of an unlicensed person to drive a horse drawn vehicle or the physical operation of such a vehicle by an unlicensed person is a violation of this section and is declared to be a municipal infraction punishable by a fine of one hundred dollars ($100.00) issued to the operator of the business and/or the driver of the carriage.
