Sec. 22-10.1. Other improvements in curb strips, streets, etc.


(a) It shall be unlawful for any person to place any mailbox, post, shrub, or other improvement, with the exception of newspaper boxes, in any public way, street or avenue, sidewalk or in the area between the sidewalk and curb, without first securing the written consent of the city. This section shall not prohibit the planting of grass or sod in the area between the curb and sidewalk.
(b) Vending machines shall be prohibited in any public way, street or avenue, sidewalk or the area between the sidewalk and curb within the Frederick Historic District, with the exception that vending machines located within the Frederick Historic District as of the date of adoption of this section shall be permitted to remain in place only until the business establishment which obtains profits from said machine(s) as of the date of adoption of this section no longer has an ownership or lease interest in the business establishment.
(c) All vending machines must maintain a permit from the city and permits must be obtained within forty-five (45) days of the effective date of this section. The permit fee shall be the sum of twenty-five dollars ($25.00) per year for any number of vending machines located at a business.
(d) Violation of this section is declared to be a municipal infraction. The penalty for violation shall be the sum of twenty-five dollars ($25.00) per day. (Ord. No. G-79-14, § 1, 9-6-79; Ord, No. G-80-25, § 1, 7-17-80; Ord. No. G-91-7, § 1, 4-48-91; Ord. No. G-91-19, § 1, 10-17-91)
