Sec. 15-22. Harassment, injuring, maiming and killing of police canine prohibited.


(a) It shall be unlawful for any person wilfully:
(1) To taunt, torment, tease, annoy, harass, alarm or otherwise interfere with any dog or canine used by the Frederick Police Department or other municipal, county or state law enforcement agency or department in the performance of the law enforcement functions or duties of such department or agency; or
(2) To commit any of the aforementioned acts in the course of interfering with any such dog or canine used by the Frederick Police Department or such other law enforcement agency or department or any member or officer thereof in the performance of its law enforcement functions or duties;
(3) Violation of this subsection is declared to be a misdemeanor. The penalty for violation of this subsection, upon conviction, shall be a fine in an amount not to exceed five hundred dollars ($500.00) or imprisonment for not more than ninety (90) days, or both.
(b) It shall be unlawful for any person wilfully:
(1) To injure, poison, maim or kill any dog or canine used by the Frederick Police Department or other municipal, county or state law enforcement agency or department in the performance of the law enforcement functions or duties of such department or agency; or
(2) To commit any of the aforementioned acts in the course of interfering with any such dog or canine used by the Frederick Police Department or such other law enforcement agency or department or any member or officer thereof in the performance of its law enforcement functions or duties;
(3) Violation of this subsection is declared to be a misdemeanor. The penalty for violation of this subsection, upon conviction, shall be a fine in an amount not to exceed one thousand dollars ($1,000.00) or imprisonment for not more than six (6) months, or both. (Ord. No. G-98-18, § 1, 5-21-99)
