Sec. 15-21.7. Penalties.


(a) Penalty for violation. Violation by any person of any provision of this ordinance is declared to be a municipal infraction punishable by a fine in the amount of one hundred dollars ($100.00) for the first offense. Upon a second violation of this ordinance within a twelve-month period, said person will be fined five hundred dollars ($500.00). Upon a third or subsequent violation of this ordinance within a twelve-month period, said person will be fined one thousand dollars ($1,000.00).
(b) Each day a violation occurs will be considered a separate offense, and each time that a violation is committed in any one day shall be considered a separate offense.
(c) Police officers, or other duly appointed and authorized city officials, may issue orders to cease and desist under guidelines approved by the City of Frederick.
(d) In addition to the foregoing remedy, the city may seek any other remedies available to it at law or in equity.
(e) A violator who has submitted to the city a plan for compliance with this ordinance and has that plan or amendments to it approved by the city may not be considered to be in violation of this ordinance as long as he or she acts in accordance with the original or amended plan. All such plans for compliance will be on file with the office of legal services and the City of Frederick police department.
(f) Nothing herein should be construed to prohibit enforcement of this ordinance by the Maryland Department of the Environment. (Ord. No. G-02-9, § 1, 6-6-02)
