Sec. 12.5-28. Responsibilities of persons.


(a) The property owner. Only the property owner shall be responsible for compliance with the provisions of this code, except for those provisions as cited in the code that are the responsibility of the tenant, and only the property owner may be cited for violations of it, except as provided in this regulation. A person may not rent or lease to another person for occupancy or use any housing unit unless the structure and premises comply with the provisions of this code.
A property owner may not be cited for violation of this code that is caused by the negligent, wrongful, or malicious acts or omissions of a tenant, provided that the property owner’s acts or omissions have not contributed in any way to cause the violation.
(b) The tenant. The tenant shall be responsible for those (items) that are stipulated as the tenant’s responsibilities and may be cited under the terms of municipal infraction for any violation. (Ord. No. G-88-21, § .17, 12-8-88)
