Chapter 10 SOLID WASTE MANAGEMENT*
ARTICLE II. WASTE COLLECTION AND DISPOSAL
Sec. 10-20. Enclosures.
(a) Enclosures shall be designed, located and constructed in
accordance with city standard construction details and pursuant to the direction
of planning commission of the city. All dumpsters shall be situated on a poured
concrete platform. If the director of public works determines that a noncity
maintained road could be damaged by garbage trucks or could be unsafe for them
to travel, or if the location poses a threat to the safety of collection crews,
collection equipment, or private property, then an alternative pick up location
will be assigned. If an alternative site cannot be found, then the director of
public works reserves the right to discontinue service.
(b) Enclosures shall be maintained so as to continually
function as originally designed and constructed. The property owner, tenant
and/or person in control or possession of the property shall be responsible for
maintaining the enclosure in a manner as to be clean, deodorized and with all
trash securely contained in containers so as to prevent littering or
animal/insect infestation, and to maintain safe and clear access to and through
the premises for the purpose of collecting refuse. The property owner, tenant
and/or person in control or possession of the property shall be responsible for
the removal of snow/ice and the prevention of obstructive vehicle parking near
the enclosure. Violation of this section shall constitute a municipal infraction
punishable by a fine not to exceed four hundred dollars ($400.00). (Ord. No.
