Sec. 10-5. Accumulation of refuse.


(a) No person or property owner shall dump, or allow to accumulate either directly, or through an employee, agent, tenant or licensee, any refuse outside of a designated refuse storage container/area or allow such matter to be washed, to flow or to be carried in any manner from one property to another. Violation of this section is declared to be a municipal infraction. The penalty for violation shall be a fine not to exceed three hundred dollars ($300.00).
(b) The person or property owner must remove any refuse which, in the opinion of the department of code enforcement, is detrimental to the public health or constitutes a nuisance. Such refuse must be removed within twenty-four (24) hours of the date of receipt of the notice. In the event that any person or property owner shall fail or refuse to comply with such notice within twenty-four hours, they shall be fined one hundred dollars ($100.00) for each successive twenty-four (24) hour period.
