(a) No person shall throw, dump, deposit, or bury any refuse in or upon any street, sidewalk, park, or other public place, vacant lot or other vacant place; or in or upon any premises, waterway, drainage basin, or sewer within the city without the written consent of the owner thereof or under the personal direction of such owner. Violation of this section is declared to be a municipal infraction. The penalty for violation shall be a fine not to exceed three hundred dollars ($300.00).
(b) The violator shall remove any illegally dumped material within twenty-four (24) hours of notice of violation. In the event that the violator shall fail or refuse to comply, he shall be fined one hundred dollars ($100.00) for each successive twenty-four (24) hour period. At any time, it shall be lawful for the city to remove and dispose of the material and charge the cost to the violator. (Ord. No. 99-33, § 1, 7-15-99)
