Sec. 10-8. Hazardous materials/waste.



(a) It shall be unlawful for any hazardous materials and/or waste to be deposited, disposed of and/or placed either inside a refuse container or otherwise, upon any curb, street, public way or other designated areas for collection by the city or its contracted agents. Violation of this section is declared to be a municipal infraction. The penalty for violation shall be a fine not to exceed one thousand dollars ($1,000.00).

(b) The violator shall remove any hazardous material/waste within twenty-four (24) hours of notice of violation. In the event that the violator shall fail or refuse to comply within twenty-four (24) hours, he shall be fined two hundred dollars ($200.00) for each successive twenty-four (24) hour period. At any time, it shall be lawful for the city to remove and dispose of the material and charge the cost to the violator. (Ord. No. 99-38, § 1, 7-15-99)
