Sec. 10-17. Service level--Downtown commercial district.



(a) The city, or its agents, shall provide all refuse collection and removal services for the Downtown Commercial District. Places of business in the Downtown Commercial District may petition the city for exemption from this statute via the Streets and Sanitation Committee.

(b) Base level of service. Each place of business in the Downtown Commercial District may set out up to three hundred twenty (320) gallons of refuse per week. Discarded cardboard will not count towards this quantity limitation if properly collapsed, bundled, and bound.

(c) Supplemental service. Any place of business in the Downtown Commercial District is subject to supplemental service fees when their refuse set out exceeds three hundred twenty (320) gallons of refuse per week. The fees for this service are based upon the cost of the services provided.

(d) Containers. Places of business in the Downtown Commercial District will be required to use specially designated refuse containers. The customers shall be required to purchase the designated containers from the department of public works, or from a manufacturer or vendor designated by the department. All places of business shall be required to use the specially designated containers unless they can show cause why they cannot to the department of public works. The department of public works may also deny the use of these containers in situations where operational constraints preclude their use. In these unique situations, a container alternative shall be agreed upon by both parties.

(e) Schedules. Refuse shall be collected from within the Downtown Commercial District twice weekly on the days designated by the director of public works. The places of business whose properties front the following streets shall receive service Monday through Saturday:

(1) North Market Street--from Patrick Street to Seventh Street;

(2) South Market Street--from South Street to Patrick Street;

(3) East Street--from East Patrick Street to Second Street;

(4) West Patrick Street--from South Bentz Street to Market Street;

(5) East Patrick Street--from Market Street to East Street.

(f) Fees incurred pursuant to the provisions of this section shall be billed to the customer by the finance office with terms and provisions matching those used for the billing of city water and sewer services.
