Sec. 9-1.2. Automatic fire sprinkler systems in new residential occupancies.


(a) Scope. Except as provided in subsection (d), this section applies to every residential occupancy, as defined in the NFPA 1 Uniform Fire Code, for which a building permit application is submitted on or after October 1, 2006, including a residential occupancy constructed as a replacement for a residential occupancy which has been razed or destroyed.
(b) General requirement. Every new residential occupancy must be equipped with an interior automatic sprinkler system. The city will not issue a certificate of occupancy for any residential occupancy unless this requirement has been met.
(c) Installation and maintenance. Every automatic sprinkler system installed in accordance with this section shall be installed and maintained in accordance with accepted engineering practices and the applicable NFPA standards.
(d) Exceptions. The requirements set forth in subsections (b) and (c) do not apply to:
(1) Any residential occupancy in existence before October 1, 2006 or for which a building permit has been submitted before October 1, 2006;
(2) The refurbishment, renovation, addition, or alteration of a residential occupancy in existence as of October 1, 2006; or
(3) Any residential occupancy located on a lot for which a three-fourths inch water line was installed from the street to the property line before October 1, 2006 in accordance with improvement plans approved by the city. This subsection (d)(3) shall be effective as to a residential occupancy for which a building permit application is submitted before July 1, 2007, and shall be of no further legal effect on or after July 1, 2007.
