ARTICLE II. ADOPTION OF CODES
Sec. 5-9. Residential code--Scope, intent and applicability.
(a) The provisions of the residential code apply to the construction,
alteration, movement, enlargement, replacement, repair, equipment, use and
occupancy, location, maintenance, removal and demolition of detached one- and
two (2) family dwellings and multiple attached single-family dwellings
(townhouses) not more than three (3) stories in height with separate means of
egress, and their accessory structures, within the city.
(b) The purpose of
the residential code is to provide minimum requirements to safeguard the public
health, safety and welfare.
(c) Wherever different sections of the
residential code specify different requirements, the most restrictive governs.
Wherever there is a conflict between a general requirement and a specific
requirement, the specific requirement applies. Wherever there is a conflict
between the residential code and a code or standard referenced therein, the
provisions of the residential code apply. (Ord. No. G-05-18, § 12,
