ARTICLE III. ADMINISTRATION
Sec. 5-16. Inspections.
(a) The code official shall have the authority to enter at any
reasonable time any structure or premises for which a permit has been issued to
inspect for compliance with the permit, any construction documents pertinent
thereto and the applicable provisions of this article and the technical codes.
The department’s employees shall carry proper identification when
inspecting structures or premises in the official performance of their duties
under this code and the technical codes.
(b) Prior to entering into a space
not otherwise open to the general public, the code official shall make a
reasonable effort to locate the owner or other person having charge or control
of the space or premises, present proper identification and request entry.
Failure or refusal by the owner or other person in charge of the space or
premises to permit such entry shall constitute a violation of this article. Such
right of entry and inspection shall be enforced by application to and proper
orders from a court of competent jurisdiction.
(c) Every occupant of a
structure or premises shall give the owner or operator thereof or agent or
employee, access to any part of such structure or premises at reasonable times
for the purpose of making such inspection, maintenance, repairs or alterations
as are necessary to comply with the provisions of this article and the technical
codes and with any notice or orders issued pursuant thereto.
(d) A record of
all inspections and violations of this article or the technical codes shall be
maintained by the code official in accordance with the city’s records
retention policy.
(e) The owner shall provide for special inspections in
accordance with the building code.
(f) The code official shall accept
reports of approved inspection agencies provided such agencies satisfy the
department’s requirements as to qualifications and
reliability.
(g) Where required by the provisions of the technical codes or
regulations, materials or assemblies shall be inspected at the point of
manufacture or fabrication in accordance with applicable provisions of the
technical codes.
(h) Whenever in the enforcement of this article or the
technical codes, the responsibility of more than one official or department is
involved, it shall be the duty of the officials involved to coordinate their
inspections and administrative orders as fully as practicable so that the owners
and occupants of the premises shall not be subjected to visits by numerous
inspectors or multiple or conflicting orders. Whenever an inspector from any
agency or department observes an apparent or actual violation of some provision
of a law, ordinance or code not within the inspector’s authority to
enforce, the inspector shall report the findings to the code official having
jurisdiction. A department shall not, however, delay the issuance of any
emergency orders.
(i) When any part of any work performed under the building
code or any of the technical codes is to be hidden from view by the permanent
placement of parts of a building, the person making the installation shall
notify the code official and such installation shall not be concealed until it
has been inspected and approved by the code official. With respect to projects
in which the concealment of the work proceeds continuously the person installing
the same shall give the code official notice thereof so that inspections may be
made periodically during the progress of the work. The code official may remove
or require the removal of any structure or portion thereof that prevents proper
